1. Scope
These terms apply in particular to STL, 3MF, CAD and comparable digital files and designs offered by Grimm3D.
2. Licence subject matter
Purchasing a file does not grant the purchaser copyright or exclusive rights in the design. The purchaser receives only a simple, non-exclusive and generally non-transferable right of use within the scope of the product description and these terms.
3. Private standard licence
Unless otherwise stated for the product, the purchaser may store the file for their own private use, make reasonable backup copies, use it privately with a 3D printer and technically adapt it to a printer or slicer for their own use. Commercial use is not included.
4. Prohibited sharing
- No sale, resale, gifting or exchange of the digital file.
- No publication or provision on websites, forums, social networks, cloud shares, file-sharing services or 3D model platforms.
- No distribution of copies.
- No distribution or marketing of edited, converted, scaled or supplemented versions insofar as they contain protected elements of the Grimm3D design.
5. Printed products
The private standard licence does not authorise commercial sale of physical products made on the basis of the file. An express commercial licence from Grimm3D is required for this. Such a licence also does not automatically permit the sharing or sale of the original digital file.
6. External printing providers
A file may be provided to an external printing provider only to the extent of the specific licence and for manufacture of the specific order. The provider may not use it for its own purposes, share it, publish it or use it for other customers.
7. No sublicensing
Rights of use may not be transferred or sublicensed to third parties without Grimm3D's express consent, insofar as legally permissible.
8. Infringements
Where the file is used outside the granted licence scope, Grimm3D reserves the right to assert the claims available under law, in particular, where the requirements are met, claims for injunctive relief and damages.
9. Statutory rights
Mandatory statutory rights, in particular consumer rights and rights in respect of defects, are not restricted by these licence terms.
10. Relationship to the General Terms and Conditions and applicable law
The General Terms and Conditions of Grimm3D apply in addition. German law applies; for consumers, only insofar as mandatory protections of the state in which they habitually reside are not withdrawn.
