1. Provider and scope

These General Terms and Conditions apply to contracts between Grimm3D, owner Kai-Andre Grimm, Hauptstraße 62c, 26188 Edewecht, Germany, email: Kontakt@grimm3d.de, and its customers.

They apply in particular to the sale of Grimm3D's own 3D-printed products, custom-made products, 3D printing services based on customer files or specifications, design and adaptation services, and digital STL, 3MF, CAD and comparable files. Distribution may take place in particular via www.grimm3D.de, Etsy, eBay or following an individual enquiry.

2. Formation of contract

For individual printing, design or adaptation orders, the customer may first submit a non-binding enquiry. Grimm3D checks technical feasibility and may then submit an individual offer. A contract is formed when this offer is accepted or through a correspondingly structured ordering and payment process.

For orders via Etsy or eBay, the formation of contract is additionally governed by the respective platform's terms and technical procedures.

3. Prices and payment

The prices stated or individually agreed at the time the contract is concluded apply. If Grimm3D uses the small-business scheme under section 19 of the German VAT Act (UStG), VAT is not shown separately. Depending on the sales channel, PayPal, bank transfer, credit card and the payment methods offered by Etsy or eBay may be available.

4. Grimm3D's own products

Grimm3D develops, designs, manufactures and sells its own 3D-printed products. The mere fact that a product is made only after an order has been received does not automatically make it a custom-made product. Statutory consumer rights apply to non-customised products.

5. Custom-made products

Grimm3D offers products whose dimensions, lettering, geometries, designs or other essential characteristics can be specified according to the customer's individual requirements. Under the statutory provisions, there is no right of withdrawal for goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer's personal needs. Statutory rights in respect of defects remain unaffected.

6. Printing service and customer files

Customers may provide their own files, drawings, models, dimensions or other specifications for review and manufacture. The customer warrants that they are entitled to use and transmit this content and that no third-party rights are infringed. Grimm3D may reject orders in particular where they are technically impossible or there are indications of unlawful use.

7. Digital products

Digital content may be provided in particular via a download area, customer account, download link or email. Purchasing a file does not transfer copyright in the underlying design, but only the rights of use specified in the product description and licence terms.

8. Protection of digital files

  • No sharing, resale or free distribution of the file.
  • No upload to websites, forums, social networks, file-sharing services or 3D model platforms.
  • No distribution of edited or converted versions insofar as they contain protected elements of the Grimm3D design.
  • Commercial sale of printed parts made from a Grimm3D file is permitted only with an express commercial licence.

9. Withdrawal for digital content

For paid digital content not supplied on a tangible medium, the statutory right of withdrawal may expire when performance of the contract begins if the statutory requirements are met. In particular, the consumer must expressly consent to performance beginning before the withdrawal period expires and confirm that they are aware that this causes the right of withdrawal to be lost. Grimm3D provides the legally required confirmation of the contract.

10. Delivery

Physical goods are generally shipped with DHL unless otherwise agreed. Shipping costs and delivery or production times are shown before the contract is concluded or stated in the individual offer.

11. Characteristics of 3D-printed products

3D printing is a layer-by-layer manufacturing process. Process-related visible layer lines and minor deviations in surface, structure or colour may occur. Such characteristics do not automatically constitute a defect where the agreed quality, function and ordinary usability are not impaired.

12. Rights in respect of defects

Statutory rights in respect of defects apply.

13. Copyright and intellectual-property rights

Grimm3D's own designs, models, drawings, product designs, files, images and other content remain protected under the statutory provisions. Buying a physical product does not grant any rights to the digital design files used to manufacture it.

14. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as mandatory consumer-protection provisions of the state in which they habitually reside are not withdrawn. The statutory rules on jurisdiction remain unaffected.

1. General liability

Grimm3D is liable without limitation under the statutory provisions for damage arising from injury to life, body or health and for damage caused by intentional or grossly negligent conduct. The same applies to mandatory liability under product-liability law and in other cases where liability may not be excluded or limited by law.

2. Ordinary negligence

In the event of a slightly negligent breach of essential contractual obligations, Grimm3D is liable in accordance with the statutory provisions. Where a limitation of liability is legally permissible, liability is limited to the foreseeable damage typical for the contract. Mandatory statutory claims remain unaffected.

3. Technical and functional 3D-printed parts

For technical or functional 3D-printed parts, the agreed purpose, the material used and the load, temperature and operating limits communicated to the customer must be observed. Products must not be used outside an expressly stated or reasonably foreseeable area of use. Changes made by the customer, improper assembly or use contrary to expressly issued safety or operating instructions may be taken into account when assessing responsibility.

4. Safety-critical applications

Suitability for safety-critical applications exists only where Grimm3D has expressly confirmed this for the specific product. This applies in particular to applications in which failure of the part could cause significant personal injury or property damage. Required product-specific safety, testing, labelling or conformity requirements remain unaffected.

5. Customer files and customer designs

For printing orders based on a design, file, drawing or technical specification provided by the customer, the customer is responsible for the accuracy and suitability of their specifications unless Grimm3D has expressly undertaken its own design, calculation or testing service. This does not release Grimm3D from its own mandatory statutory obligations or responsibility for errors arising from the manufacture owed by Grimm3D or a service undertaken by Grimm3D.

6. Selection of material and manufacturing process

Where the customer bindingly specifies material, print orientation, manufacturing parameters or other technical characteristics, the customer is responsible for the suitability of these specifications for the intended purpose unless Grimm3D has expressly warranted their technical suitability or undertaken a corresponding review. Recognisable safety risks must not be disregarded as a result.

7. Product-specific information

For individual products, Grimm3D may specify particular operating instructions, warnings, load limits, temperature ranges, assembly requirements or exclusions of certain uses. This product-specific information forms part of the information relevant to safe use.

8. Statutory rights in respect of defects and product liability

Statutory rights in respect of defects and mandatory claims under product-liability and product-safety law are not excluded or limited by these provisions. Liability that may not be excluded or limited in advance by law remains unaffected.

Important practical note: For its own products, Grimm3D should also maintain product-specific risk assessments and technical documentation and provide the required manufacturer, identification, operating and safety information. For safety-critical parts, the specific additional rules or standards that apply should be checked before sale.
